Able Adjudication is always exploring ways to provide sound decisions from highly qualified adjudicators at value for money prices. Our adjudicators have united with us to commit to provide just that and as such a new applicationĀ fees structure has been developed for release as fromĀ 24 February 2011.

Terms and Conditions Notes

1. The Claimant MUST serve a copy of the application with ALL attachments at the same time (or shortly thereafter) of making application to Able Adjudication. Able Adjudication requires the Claimant to provide evidence of application service on the Respondent within 2 business days of service (eg. Fax receipt, courier signature, statutory declaration etc).

2. Adjudication Fees include the Adjudicator fees and ANA service fees;

3. All application ranges, fees and rates listed within the Application Fee Schedule are GST inclusive with the exception of hourly rates;

4. Application types are specified as being either a Special Rate Application or a Standard Application where:

  • Special Rate applications are conditional (see below) and have a fee schedule that is either a maximum fee expressed as a dollar($) amount for the claimed amount range or as a percentage(%) of the Claimed Amount in relation to the adjudication application;
  • Standard applications are not conditional and have a fee schedule that is dependent on the rates applicable to the nominated Adjudicator. The parties will be advised of the actual hourly rate when the Adjudicator accepts the application.

Special Rate Applications

5. Special Rate applications have strict conditional criteria where:

  • An application must have less or equal to the conditional maximum number of pages (displayed in the Adjudication Fee Schedule) inclusive of all submissions forming part of the application. The final decision in its absolute discretion rests with Able Adjudication;
  • A No Payment Schedule application is one where there is no Payment Schedule as defined by the Act;
  • A Payment Schedule application is one where there is a Payment Schedule as defined by the Act.

6. Where a Claimant declares, in the application, that there was No Payment Schedule (as defined by the Act) and the Adjudicator subsequently determines that there was a valid payment schedule the adjudicator, at his/her sole discretion, may apply the Payment Schedule rates (where applicable) and notify the parties at or before the release of the decision;

7. Special Rate Application fees charged may be less than the scheduled Special Rate application fee/rate, is determined solely by the adjudicator and may be dependent on the number of hours taken to complete the decision;

8. Other than acceptance under the discretion expressed in Paragraph 5 above, where an application exceeds the maximum number of pages the capped rates will not apply and the application will be defined as a Standard application;

9. The adjudicator, at his/her sole discretion, may apply Standard Application rates where he/she considers there has been excessive submissions (either solicited or unsolicited) received during the course of the decision process and in such circumstances the adjudicator will notify the parties at or before the release of the decision;

Standard Applications

10. Standard Applications are as per the Application Fee Schedule and where Hourly Rates apply they will range between $240/hour and $320/hour GST exclusive and will be disclosed to the parties within the Adjudicator’s acceptance notice;

Administration

11. Administration fees apply to all applications and are still applicable where the application is withdrawn unless waived by Able Adjudication and the Adjudicator at their complete discretion;

12. A Claimant may request in writing to withdraw an application. The matter will be formerly withdrawn upon written agreement (from the Claimant) to make full payment of the Withdrawal fees which will include the Administration fees plus any Adjudicator fees (where applicable) incurred at the time of notice;

13. No Certificate Fees apply for any claim;

14. No disbursement fees apply for any claim unless the ANA is required to serve documents for and on behalf of the parties as a result of a requirement of the legislation, a request from a party, a request from the adjudicator or the need to use courier/express delivery services (20% on-cost will apply);

15. Credit Card payment is by Mastercard or Visa only and a 2% surcharge applies;

16. The Adjudicator’s decision will be released on receipt of the invoiced total fee amount as cleared funds in Able Adjudication’s Bank.
