To make a Security of Payment adjudication there are critical documents that must be distributed between the parties and dates to meet to ensure compliance with the Act.
The must document that everything hangs off is a valid Payment Claim and the date on which the Respondent receives the Payment Claim (not when it is dated or sent).
Other critical things to remember that should be addressed in the Adjudication Application or Adjudication Response (where applicable) are the:
1. Reference Date
2. Payment Claim
3. Payment Schedule
4. Due Date For Payment
5. Application notice (2nd Chance Notice)
6. 2nd Chance Payment Schedule
7. Service of documents
If any document comes into play then the Claimant or Respondent should provide the document and evidence of service of the document.
